GENERAL CONDITIONS 

 

The Lica design studio /Elisa Ostländer is a textile design studio that produces individual print designs based on its own 

ideas and markets its products to customers worldwide.

 

TEXTILE PURCHASING PROCESS

Once the customer has agreed to purchase a ready-made textile design, which can be done either by 

email or by signature in electronic or “wet ink” form, the purchase is deemed final. By doing so, he has 

made an “art request”.

The customer will receive the corresponding sample swatch or paper printout from lica design studio. 

A sample swatch is a piece of fabric onto which the respective design is printed.

All artworks are in repeat and color separated, ready for printing. All artworks are exclusive and unique. 

 

In the case of sales that are not concluded in person, the fabric sample swatch or paper printout will be sent 

to the address specified by the customer for this purpose.

The customer will receive a link from lica design studio through which he can download 

the relevant file as high-resolution data in, at his option, PSD, TIFF, AI, EPS, editable PDF and/or large document format. 

This can take place via lica design studio‘s website system or via an online service provider such as WeTransfer.

 

SPECIAL DEVELOPMENTS 

If customer requests special print developments, a precise briefing and deadline is needed. 

The request for a special development corresponds to an order and is billed at the price listed in the offer . 

Lica design studio will prepare 2 raw designsketches without pattern repeat. In this stage the customers should select. 

Now the final print will be finished incl 2 customized colorations. This development will not be printed on silk.

 

CHANGES

All change requests must be made in writing. If work has to be re-done because an incorrect brief has been 

supplied by the client, or the brief changes in any way, we have the right to charge for changes made at our 

current hourly rate. 

 

OVERDUE INVOICE FEES

Within 48 hours, the customer will also receive the invoice by email at the address he provided for this purpose.

The invoice must be paid within 30 days.

An administration fee of 30,-€ will be charged if payment is not received by the due date of invoice. 

If an amount remains delinquent 4 weeks after its due date, 20% of the total cost of the project will be added 

for each month of delinquency.

The notice can be sent by mail or email.

If payment is not received from the customer, lica design studio has the right to withdraw from the sales contract 

with the customer.

In this case, the customer agrees to immediately return the relevant fabric sample swatch to lica design studio 

at his own expense and to irretrievably delete all files and copies of the respective design. 

The customer must prepare and deliver, without delay, a corresponding written statement regarding the deletion 

of the data at the request of lica design studio.

 

RIGHTS OF USE

Only after full payment for the design does the customer receive the sole, simple rights of use at his premises. 

This means, among other things, that he can recolour, alter and reproduce the design as and/or as often as desired 

without restrictions in terms of time and space.

 

COPYRIGHT

Once lica design studio receiving the final payment for a design in full, the copyright to the design is automatically 

transferred to the client. 

In return, lica design studio will not sell the design to any other customer. From this moment forward, it is considered

 „sold out”.

lica design studio reserves the right to use designs created by our studio in our portfolio for marketing purposes 

online or offline

All work supplied by lica design studio is believed to constitute original work, and is prepared in good faith that 

it does not infringe the rights of any other party. lica design studio cannot provide an absolute guarantee that any 

specific works do not infringe upon existing third-party rights, inadvertently, by coincidence or otherwise.

lica design studio is unable to guarantee that any work supplied to the client is suitable for any particular purpose 

and would strongly recommend that the client conduct relevant research prior to the approval of any prepared work.

All preliminary work and materials produced by lica design studio for the purposes of developing any work remain the 

sole property of lica design studio (excluding and incorporated materials supplied by the client). Any unauthorised 

usage of materials produced by lica design studio will be actively pursued through legal channels.

By approving any final work whether verbally or in writing, the client assumes the responsibility for the subsequent 

usage of the chosen work. lica design studio retains the right to re-use any original material that does not form part 

of any final approved work.

lica design studio cannot take responsibility for any copyright or privacy infringements caused by materials submitted 

by the client and may refuse use of any such material unless proof of permission is provided.

 

PROOFING AND APPROVAL OF FINAL ARTWORK

The client is responsible for proofing all artwork and content thoroughly. lica design studio accepts no responsibility 

for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production.

Any changes made to a project after the client has approved any final work, whether verbally or in writing, 

will be billed to the client.

 

PLACE OF JURISDICTION 

The place of jurisdiction is the registered office of lica design studio / Elisa Ostländer.
